attorney-client relationship. Have a business attorney in your state review
and finalize this before you take a customer's money. If you serve schools in
states with specific student-privacy laws (e.g., California's SOPIPA), ask
your lawyer about those too.
Swim-school OS — Terms of Service
1. The service. Swim-school OS provides scheduling, makeup management,
skill tracking, billing records, parent communications, and instructor
deck-view software for independent swim schools, billed at a flat monthly
rate ($99/mo Starter, $149/mo Growth). We may update features; the flat-rate
pricing promise (no per-student fees) is the core of the product.
2. Your account. You must be an authorized representative of the swim
school. You are responsible for the accuracy of the data you enter and for
who at your school has access.
3. Acceptable use. You will not use the service to store data you have no
right to store, to send unlawful communications, or to attempt to disrupt the
service.
4. Children's data — plain-English note (not legal advice).
Student profiles in this product belong to parent/guardian accounts — the
parent creates the account and registers the child; the child never creates an
account or enters data directly. This mirrors how the incumbent platforms
work, but it does not make you (or us) automatically compliant with any law.
You are responsible for:
- getting whatever parental consent your state requires,
- honoring parent requests to review or delete their child's data promptly
(the product has a one-click per-child delete and a full-database delete
in Settings — use them),
- telling parents what you collect and why, in your own privacy notice.
We do not sell personal data. We do not use student data for advertising.
5. Payments. Plans are billed monthly in advance via the payment method
you provide. If payment fails, we may suspend access after reasonable notice.

6. Your data. You own your school's data. Export it as JSON at any time.
If you cancel, exports remain available for 90 days; after that we may delete
your data. We take reasonable measures to protect data in transit and at
rest, but no system is perfectly secure.
7. Limitation of liability. To the maximum extent permitted by law, our
liability is limited to the fees you paid in the 3 months before the claim.
We are not liable for lost tuition revenue, data-entry errors by your staff,
or third-party services (Stripe, Twilio) you connect.
8. Termination. Either side may terminate with 30 days' notice; we may
suspend immediately for material breach or non-payment.
9. Changes. We may update these terms with 30 days' notice by email; continued
use after the notice period means acceptance.
